"Every State has complete and exclusive sovereignty over the airspace above its territory," according to the Convention on International Civil Aviation, article 1. This is all the justification DPRK needs to oppose leaflet balloons. DPRK & RoK are both parties to the convention.
Convention article 3 bis (d): Parties "shall take appropriate measures to prohibit the deliberate use of civil aircraft ... for any purpose inconsistent with the aims of this Convention." RoK's violated this article for years, having provided police protection to leafleting orgs.
Convention article 8, pilotless aircraft: "No aircraft capable of being flown w/out a pilot shall be flown w/out a pilot over territory of a contracting State w/out special authorization by that State and in accordance w/ terms of such authorization."
Again, DPRK sovereignty.
Convention article 12, rules of the air: "Each contracting State undertakes to insure the prosecution of all persons violating the regulations applicable." Having protected and funded the leafleting orgs, RoK/USA have been violating this article for years.

Instead of looking at the ways that RoK and USA have violated the Convention on Civil Aviation, the UN official claims that anti-leaflet advocates are violating the rights of anti-DPRK leafleting orgs, according to the International Covenant on Civil and Political Rights.
The Intl Covenant on Civil and Political Rights does "include freedom to seek, receive and impart information and ideas ... regardless of frontiers," but w/ a caveat: "It may ... be subject to certain restrictions ... For the protection of national security or of public order."
Anti-DPRK leaflet-balloon flights originate from RoK w/ US funding, and they violate the Convention on International Civil Aviation, to which RoK, USA & DPRK are parties.
