"...there exist concerns around the transparency of process, even taking in to account that clearly
processes are quicker by design."
(putting mildly imho)
For those that may have missed - the significant (and unexpected) effective tightening of the reliability standard (now 0.0006%) occurred using the s90F mentioned above.
That will be expensive.

Directly related to the above:
Some "questioned the role of the independent market operator in a process where they may be a âbeneficiaryâ of specific choices around creation or operation of markets or control mechanisms"

"It is less clear that there is a need for the ESB to continue to have this as a standing statutory function or that the downside in terms of clarity, transparency and process in not more significant that the potential benefits."

This recommendation was not agreed (perhaps unsurprising).
(Reminder - section s90F was used *last week* to formally introduced the new 0.006% "Interim reliability measure).

Worth remembering the council always has the power to make rules (an example is the RRO - Retailer Reliability Obligation) - don't specifically need s90F for ministers to change the rules.
So we have a body:
⢠duplicates and confuses roles (with the need for s90F "less clear")
⢠has issues around transparency and process
⢠includes questionable role of the "independent" market operator.

(Unfortunately no one really seems to give a shit about NEM governance. I think it's important. )
