This may seem like just a random tweet but here the president is echoing the EXACT argument being made by the Amistad project in their lawsuit âagainstâ Mike Pence and Congress. No this is not the lawsuit that got thrown out, this is a different lawsuit.

Basically, the lawsuit says that according to the constitution, it is up to Mike Pence and the Congress to decide which electors to use in any states that were certified by governors WITHOUT the agreement of the state legislature in that state.
All of the contested states were this way. Because they were certified by governors without the legislatures permission, they are ALL subject to be overturned or decided in congress!
So the lawsuit demands that Pence and congress decide these stateâs results by themselves, that the Barton gets passed to them, based on the constitution. This may be a hint at the strategy that will be used in congress on Wednesday.
