Live-tweeting #AALS2021, the Section on #DisabilityLaw's panel: Celebrating 30 Years of Intersectionality and the ADA! Thanks for a great introduction &l leadership of the section, @katie_eyer! Now @katperez84 of @LoyolaLawSchool gives intro on DisCrit & Disability Legal Studies!
Now @JameliaNMorgan of @UConnLaw discusses her work on policing & criminalization of #Disability. While this issue has not surfaced until this moment in time and the rise of #BlackLivesMatter , the connection btwn ableism & racism has roots in history.
@RabiaBelt of @StanfordLaw talks abt the challenges of shifting ppl w disabilities from carcel spaces. The welfare system is not a panacea. Highlights issues w regard to guardianship, paternalism, respectability politics, etc. The legal protections are weak.
Sarah Lorr of @brooklynlaw talks on her experience defending parents w disabilities. The child welfare system terminates relationships btwn parents & children at rate 3 times higher when talking abt ppl of color. Parents asking for support are identified as frail and incompetent.
@katperez84 now discusses immigration & disability. The group of activists who deal with this issue is growing: activists from both groups are teaching each other how to deal w this intersection. The public charge rule is a key issue-example of how disability is constructed.
@ShinallJennifer of @vanderbiltlaw presents on intersection btwn disability & gender in the workplace. Why wage & employment outcomes fare better for men w disabilities than for women? EEOC data show how in female-dominated industries men file more disability discrim charges.
Important & insightful presentations! Now, @katie_eyer asks panelists what's their vision for intersectional disability law. @JameliaNMorgan: we need more formal recognition by organizations of issues like policing of disabled ppl of color. This is the result of advocacy efforts.
@JameliaNMorgan: demonstrates how racist concepts helped to socially construct disability through the term "mongoloid idiocy" [sic] which was historically common when referring to down syndrome.
@RabiaBelt: highlights concerns abt higher costs for disability inclusion.
@ShinallJennifer: arguments of scarcity hampers intersectional arguments under the Mcdonnell Douglas framework. Need to think of legal structures that will help courts get to more just outcomes.
@cynthia_godsoe asks how the dilemma of difference as articulated by Martha Minnow affects asking for accommodations?
@ShinallJennifer: hiding information can backfire.
@RabiaBelt: attitudes abt disability can be changed if others see someone powerful asking for accommodations.
@DorfmanDoron: how does Bostock affects intersectional disability law?
@katie_eyer: The decision highlights that there can be various multiple causes that affect adverse action, promoting intersectional claims.
@RabiaBelt: No need for gender dysphoria as impairment under ADA.
