The article examines the state and business construction of commodified housing, critiques current human rights responses to it, and provides a new framework for applying IHRL (ICESCR and UNGPs) to harms caused by commodification, esp. unaffordable costs.
It argues commodification causes harm that can be constructed as ‘clear violations’ of rights. It creates a new framework to challenge these violations based on a three-step process to set standards, identify breaches, and set policies as comply or explain obligations.
