Where does one go to if they want to adopt?
An adoption order is acquired in the children’s court (usually magistrates) in the district where the applicant or minor resides.
Applications for adoption orders are made in private and no unauthorised persons are permitted in court.

A court can grant an adoption order to:
1.A person who has never been married.
2.Jointly to married persons.

What are the restrictions?
One cannot adopt a minor who is less than 25 years younger than them unless they are of the same sex, or if the person is a widow, widower, unmarried or divorced and is the parent of the child.

An adoption order will not be granted if one spouse fails to give consent unless that spouse is incapable to give it or spouses have separated and living apart.
An adoption order will not be given to someone who is not resident in Zimbabwe unless they are a close relative.

There are instances where an adoption order is only given with the minister’s consent. Such instances are when the applicant is under 25 years or less than 21 years older than the minor they seek to adopt.

On relation the law uses the term “ prohibited degree of consanguinity” which basically means a blood relatedness or relation which make certain actions prohibited such as in incest.

What is the role of social services?
When an application is made to the court, the court appoints a probation officer to be a guardian pending the hearing. His or her opinion or recommendation may also be required by the court

What is the effect of adoption orders?
The order confers on the child the surname of the adopter. The adopted will have the same rights as any child of the adopter. All rights duties and liabilities of the parent or guardian shall apply to the child.

The identity of an adopted child and adopter shall be concealed and cannot be revealed without the consent of the adopter or child if above 18. The Minister can also give such consent if it is just, equitable or in the interest of the person.
